Construction Practice Group’s Melisa Roy Published in December Issue of Virginia Lawyer magazine

In the December issue of Virginia Lawyer magazine, Melisa Roy wrote an article about the subject of subcontractor Pass-Through Claims in Virginia. As Melisa explains, a Pass-Through Claim addresses the lack of privity that prevents the subcontractor from claiming directly against the owner for the damages, since subcontractors generally are in contract with the prime contractor, not the owner of the project. However, whether or not these claims are permissible in Virginia is unclear, as the Supreme Court of Virginia has never ruled on the issue. To read the entire article, click here.
